1. Acceptance of Terms

By requesting or scheduling services with Saguaro Spas (“we,” “us,” “our”), you (“Client,” “Customer,” “you,” “your”) agree to be bound by these Terms and Conditions. These Terms govern all services including maintenance, repairs, diagnostics, and any contractual agreements. If you do not agree, do not schedule or accept services.


2. Scope of Services

Saguaro Spas provides professional above-ground spa/hot tub maintenance, diagnosis & repair services throughout the East Valley of Arizona, including routine water care, equipment inspections, chemical balancing, leak detection, and repairs. (saguarospas.com)

Services include (but are not limited to):

Weekly or bi-weekly maintenance plans

Drain & clean services

Spa diagnostics and repairs

Free or paid estimates as agreed

Detailed scope, pricing, and service schedules will be provided in your service agreement.


3. Estimates and Work Authorization

1. Estimates — We may provide a free estimate for repair or maintenance services. Estimates are approximations based on current information and may change if scope increases.

2. Authorization — You must provide written or verbal authorization (confirmed by email or text record) before work begins. Unauthorized work may not be covered under warranty.


4. Scheduling and Access

1. Scheduling — Maintenance visits and repairs are scheduled in advance. You agree to provide access to the spa at the agreed time and allow sufficient time for technicians to complete work.

2. Access — If a technician cannot access the spa at the scheduled time due to customer absence or obstruction, a rescheduling fee may apply.


5. Payment Terms

1. Payment Due — Unless otherwise agreed, payment is due upon completion of service. For recurring services, we may offer monthly billing.

2. Accepted Methods — We accept credit card, debit card, ACH/online payment, and any other method agreed in writing.

3. Late Payments — Payments past due may incur late fees of ___% per month until paid. Services may be suspended until payment is current.


6. Cancellations and Rescheduling

1. Maintenance Services — If you need to cancel or reschedule a maintenance visit, please notify us at least 24 hours before the scheduled appointment.

2. Repairs/Inspections — For scheduled repair visits, please notify us at least 48 hours in advance if canceling or rescheduling.

Late cancellations or no-shows may incur a cancellation fee.


7. Warranty Policy

1. Workmanship Warranty — We offer a one-year parts and labor warranty on eligible repairs, as specified in your service agreement. (saguarospas.com)

2. Warranty Limitations — The warranty does not cover:

Pre-existing conditions not disclosed before service

Damage from misuse, neglect, improper installation by others

Acts of nature (flood, fire, storm, etc.)

Chemicals or components not supplied or recommended by us

3. Warranty Claims — To make a warranty claim, contact us with proof of service and a description of the issue.


8. Customer Responsibilities

Clients agree to:

Provide safe access to spa equipment and electrical connections

Maintain proper spa cover and electrical disconnect access

Provide accurate information about spa issues

Comply with any water balance or maintenance guidance we provide

Clients remain responsible for damages caused by misuse or failing to follow care instructions.


9. Liability and Limitation of Damages

To the fullest extent allowed by law:

Saguaro Spas is not liable for indirect, incidental, or consequential damages arising from services.

Our maximum liability for any claim is limited to the total amount paid by you for the specific service that gave rise to the claim.


10. Privacy and Data Protection

We protect your contact and billing information. We will not share personal data with third parties without your consent, unless required by law or to fulfill contracted services.


11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Arizona.

Any dispute must first be addressed through informal negotiation. If unresolved, either party may pursue legal action in a competent Arizona court.


12. Amendments

We may update these Terms. Updated Terms will be posted on our website and take effect upon posting. Your continued use of our services after changes signifies acceptance.

13. SMS / Text Messaging Consent

By providing your phone number through our website contact or service request forms and actively checking the SMS consent checkbox, you agree to receive SMS messages from Saguaro Spas. Messages may include appointment confirmations, service notifications, reminders, and promotional offers. Message frequency may vary. Message and data rates may apply.
